Will I lose my car/motorbike in bankruptcy?

 
 

You may be aware that in bankruptcy your assets may be of interest to the Official Receiver, however your car will not be taken away from you in every circumstance, and in fact most of the time you are allowed to keep your car.

Vehicle guidelines


You need to have a valid reason for owning the car, such as getting to work and picking the kids up from school.

Also, if public transport isn't practical, or would cost more than the cost of running the car on a monthly basis then you can keep the car.

Usually any vehicle exceeding the value of around £2,500 will be deemed too excessive. In some cases the Official Receiver will allow you to keep the car if you buy out the beneficial interest.

Scottish Bankruptcy Help

Personal bankruptcy for Scottish residents is called Sequestration.

To be sequestrated you must owe at least £1,500 and either: one or more of your creditors must have taken you to court to enforce or demand you repay a debt or you must have been on a debt payment programme under DAS that has been revoked and one of the creditors in the DPP have been to court and obtained a decree on one of the debts.
